Who is able to shop on our website?

Accessing the Website and/or purchasing a product or products, means that you fully accept (without limitation or qualification) the details laid out in this privacy policy. You also confirm that you are more than 16 years of age.

Anyone found in violation of the guidance in this privacy policy will be barred access to the Website. We reserve the right to withhold our services, with immediate effect, from anyone that breaks the privacy policy provisions.


Special note on card transactions and payments

All card transactions are carried out over a secure SSL encryption. Card details are not stored on our server or anywhere else by us.

Why does Modessic collect personal data?

MODESSIC collects and stores personal data with your express consent. We do this when we need your personal data or information to enter into some form of contract with you and processing your data is done for legitimate reasons. In some instances, there may be a legal obligation on us to collect personal data from visitors and customers.

We collaborate with other service providers and sometimes there will be a need to share or process your data. By using our Website or ordering products, you are indicating that this is acceptable.

What personal data does Modessic collect?

When you place an order on the Website, we process your personal data to administer your purchase, dispatch the goods, and fulfil our legal retail obligations.

The specific personal data that MODESSIC collects are:

  • Postal address for delivery
  • E-mail address
  • Contact telephone number
  • Payment and order history

Any other personal data will be given of your own volition, for instance if you make direct enquiries about Modessic, when you sign up for marketing and sales communication, or when you request job opportunity details to work with us.

With whom does Modessic share your personal information?

We only share your personal information with selected third parties that use it for legitimate retail business purposes. For example, we run our e-commerce website on the Shopify platform, so your personal information will be shared with Shopify. Modessic’s Cookie Policy

Modessic follows the guidance set out in the Electronic Communications Act (25th July 2003). A cookie is a text file that is stored on your device or computer, containing identification and tracking information on the visitor. Cookies are harmless, contain only text data, do not carry electronic viruses, and take up very little storage space on your device or computer.

Information relating to visitors who visit the website is automatically collected and stored, including some basic data and information related to your web browser, location time zone, IP address, and other cookies stored. As you navigate the site, we gather information on the web pages and products viewed, how you were referred to the website (search engine, ad link, etc.), and other basic information on your browsing behaviour and website interactions (time spent on pages, links clicked, etc.).

In line with the Electronic Communications Act, Modessic only collects cookie information using the following methods:

  • Creation of Log Files – we track actions you take on the site and collect data such as IP address, web browser type, ISP, referral links, data and time stamps. This information is stored in a text log file.
  • Records of Browsing Behaviour – we apply common tools such as web beacons, tags and pixels which are electronic tracking files that record browsing information while you visit our Website.

 

Third party Cookies

Modessic also applies some third party cookies for visitors to the website, which are as follows:

Cookies are entirely optional and can be disabled and the storage of cookie information prevented by you at any time by applying web browser configurations to block them. However, we must inform you that blocking cookies may prevent you from using the full functionality of the website.

Modessic also occasionally hosts content from other service providers and platforms, such as Google, Facebook, Twitter, etc. These third party companies may also apply cookies and other tracking tools. Modessic accepts no responsibility for the way these third party providers handle  and process personal data. Web Analytics tools used by Modessic

The only web analytics tool that Modessic applies is Google Analytics. We use this to measure and record website visitor data and generate data insights that help us improve user experience.

Google Analytics analyses web use and generates data visualizations. It was created by and is owned by Google Inc (USA). Google Analytics applies Cookies that help us to analyze how well our website is performing and how good the overall user experience is.

Information stored by Google Analytics’ cookies, regarding your website usage (including IP address) is submitted to and stored on Google’s servers which are based in the USA. What social media plugins do we use?

Modessic uses plugins that share information with third-party advertising platforms, including Google, Facebook, Instagram, YouTube, etc. The plugins allow the advertising platforms to target commercials and content that is relevant to you based on information such as browsing history, web usage patterns, etc.

The data shared with the third-party advertisers is used to create a profile of your browsing behaviour, which allows them to pinpoint the optimal time and place to display a Modessic advertisement in your browser. Advertising data is also collected to help us understand the impact and effectiveness of our advertising campaigns. To prevent us and third parties from using your data in this way, please visit the respective advertising sites (Google, Facebook, etc.) to opt out.

Please note, even if you opt out of sharing your personal information for advertising purposes, you may still see Modessic advertisements on various platforms at random.

Modessic’s marketing communication policy

Modessic operates an opt-in policy for marketing communications. In other words, you will be given the option to receive marketing communications and if you agree we will send you relevant promotional material. You may receive marketing communications in the form of promotional emails or postal promotions. This may include promotional information on our products, partners, events, sales, discounts, news, and other special offers.

To update or change your consent regarding receiving marketing communications, you can use one of the following methods:

  • edit your customer account on our website;
  • click the “unsubscribe” link at the bottom of our promotional emails;
  • contact us directly at welcome@modessic.com and request to opt-out.

A note on email marketing:

Modessic uses Klaviyo, which is a marketing automation platform. Klaviyo manages the distribution, management and subscription of our promotional email newsletters on our behalf. Subscriber’s email address data is held on Klaviyo’s servers in the USA. Klaviyo also tracks data on the performance of the emails – open rates, click-throughs, etc. and this data may be used to improve their own services such as optimizing newsletter presentation. Payment service providers

Modessic complies with all PCI-DSS financial security requirements and guidance.

If you purchase goods on our website you will use one of the following methods – Via Stripe: credit or debit card processing, Paypal or Klarna.

SHOPIFY PAYMENTS – The Processor is Stripe Payments Europe, Ltd., organized under the laws of Ireland, which is a technical services provider and may offer the services as an agent of one or more financial institutions in Sweden (each, a “Financial Services Provider”). The processing and settlement of Transactions (as defined below) (“Payment Processing”) is carried out by the Processor and any of the Financial Services Providers under a separate Stripe Connected Account Agreement, including the Sweden Stripe Services Agreement and the applicable Financial Services Terms, and to the extent you use a payment method that is subject to additional terms, the Payment Terms (collectively, the “Processor Terms”). By accepting this Agreement, you are also accepting and agreeing to be bound by the Processor Terms, which is the legal agreement between you and the Processor.

How does Modessic protect your personal data?

Modessic is careful to comply with all relevant personal data protection regulations. We are careful to apply tools, products, applications, and services that apply the principles of data privacy and protection.

Modessic has several security policies, procedures and measures in place to protect your personal data. Security measures include robust firewalls and up-to-date antivirus programs to prevent data breeches and illegal access to our network and servers.

We apply SSL (Secure Socket Layer) protocol to ensure that data is transferred securely and safely across the internet or internal networks. It is the customer’s responsibility to ensure that SSL is enabled in the web browser settings.

For additional payment security, one-way codes are used when processing credit card details.

Modessic also ensures that our employees or third parties that are authorized to access and process personal data are committed to data privacy and confidentiality and have undergone personal data protection training.

HTTP Strict Transport Security (HSTS)

HTTP Strict Transport Security (HSTS) is a web security mechanism that only allows browsers to connect with our ecommerce store using a secure HTTPS connection. Modessic apply HSTS on the website domain and is active whenever the website is live. This prevents many types of network attack, helps to maintain data privacy and security, and protects personal information.


For how long does Modessic store personal data?

When you purchase a product or products from Modessic, your data will be stored long enough for us to fulfil our retail obligations, i.e. dispatching and delivering items and activating warranties. We may keep some personal data if we are compelled to by law.

Modessic complies with personal data regulations and will not store your personal data for longer than is mandated by local or international legislation.

 Force Majeure

Extreme events that are outside of Modessic’s control, such as new government legislation, war, fire or flood, sabotage, natural disaster, etc., may release us from our contractual obligations and agreements. This is known as force majeure.

Force majeure also includes government action that may negatively affect the market or supply chain, such as restrictions, trade embargos, warnings, bans, etc. 

Additional notes on ownership and payment

Any Modessic product remains the property of Modessic until the customer makes full payment for the item or items. The price to be paid is the price specified on the day of ordering. The customer must recognize and agree to any applicable shipping and handling costs before confirming the order.

People under the age of 16 years old must seek parental permission before buying products from Modessic.

Modessic only uses third-party payment processors and does not handle or manage any financial transactions. Reputable third-party payment processor gateways are used to safeguard your financial data and personal information. Modessic does not store any credit or debit card information and all card payments are carried out with SSL encryption.

Additional information

Modessic reserves the right to amend any information and documentation as required. This includes pricing, technical specifications, terms and conditions of purchase, and our product offerings, without prior notice.

In the event of a product selling out, Modessic reserves the right to cancel the order and refund the price of the goods, including shipping and handling fees. Modessic may also notify the buyer of equivalent replacement products, if applicable.
